Terms of Service — Theo (BibleLock)

1. Acceptance of Terms

By downloading, installing, accessing, or using the Theo mobile application ("Theo," "the App," or "the Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Landslide Studios LLC ("we," "us," "our," or "the Owner").

Landslide Studios LLC is the operator of Theo and the party you are contracting with. Where the App Store lists an individual seller name, that reflects the Apple Developer Program account of record; the contracting party, the data controller, and the entity responsible for the App under these Terms is Landslide Studios LLC.

If you do not agree to all of these Terms, you must not download, install, access, or use the App. Your continued use of the App following any changes to these Terms constitutes your acceptance of those changes.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this document and, where practicable, provide notice through the App. It is your responsibility to review these Terms periodically. If you do not agree to the revised Terms, you must stop using the App.


2. Eligibility

The App is intended for users who are at least thirteen (13) years of age. By using the App, you represent and warrant that you are at least 13 years old.

If you are between the ages of 13 and 17, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf and consents to your use of the App. Your parent or legal guardian is responsible for your use of the App and agrees to be bound by these Terms with respect to your activity.

Some countries set the minimum age for valid consent to data processing higher than 13. If you are below your country's threshold, we require parental or legal-guardian consent before you may use the App; please ask a parent or guardian to contact us at the email address provided in Section 18.

App store age signals. Where your app store supplies an age category or a parental-consent signal for your account — including under the Texas App Store Accountability Act (SB 2420), enforceable since 2026, and comparable laws in Utah and Louisiana — we rely on that signal and apply the corresponding restrictions. Where your app store indicates that a minor's account lacks the parental consent its law requires, we will restrict access accordingly.

We do not knowingly collect personal information from or direct the App to children under the age of 13. If we become aware that a user is under 13 years of age, we will take reasonable steps to remove any associated data and restrict further access to the App.

If you are a parent or guardian and believe your child under the age of 13 has used the App, please contact us at the email address provided in Section 18 so that we may take appropriate action.


3. Description of Service

Theo is a faith-based productivity application for iOS that combines personalized Bible study with voluntary app blocking functionality, social features, journaling capabilities, and AI-powered study assistance. The App is designed to help users build intentional screen habits by replacing passive device usage with meaningful Scripture engagement and community connection.

The App's features include, but are not limited to:

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may add new features, remove existing features, or change the way features work. We will make reasonable efforts to notify you of material changes, but we are not obligated to maintain any specific feature or functionality.


4. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable, non-sublicensable license to download, install, and use the App on a single Apple device that you own or control, solely for your personal, non-commercial purposes.

This license does not grant you any right, title, or interest in the App beyond the right to use it as described in these Terms. All rights not expressly granted herein are reserved by Landslide Studios LLC.

This license is effective until terminated. It will terminate automatically if you fail to comply with any provision of these Terms. Upon termination, you must cease all use of the App and delete it from your device.


5. User Accounts and Your Data

5.1 Account Creation and Sign-In

To access account-dependent features (subscriptions, journals, friends, groups, church leaderboards, cloud sync of streaks and reading progress), you must create an account. You can sign in using:

These services handle your authentication. We do not directly store your Apple ID or Google credentials.

5.2 Account Data and Cloud Storage

When you create an account, we store the following information on our backend provider, Supabase (a PostgreSQL database hosted in the United States):

All account data is protected by Supabase's row-level security, which ensures you can only read and modify your own data, plus data within groups you belong to (at permissions set by group admins).

5.3 Journal Privacy Levels

Each journal entry has a privacy level only you can change:

You are solely responsible for the content you choose to share to groups or for opting into "Theo can read." Do not share sensitive personal information, financial details, or content you would not want group members to see.

5.4 Friends, Groups, and Leaderboards

5.5 Theo Assistant: AI Providers, and Conversation Memory

Theo is an artificial intelligence system, not a person and not a member of clergy. Every reply it gives is machine-generated. We tell you this in the app before your first message, in accordance with Article 50(1) of the EU Artificial Intelligence Act (Regulation (EU) 2024/1689), applicable since 2 August 2026, and California Senate Bill 243, in force since 1 January 2026.

Two providers are involved, in different roles:

Through our AWS Lambda proxy we send to Anthropic: (a) your chat message text, (b) your first name, if provided, (c) your denomination, if provided, (d) the conversation turn count, (e) excerpts from journals you opted into "Theo can read," and (f) summarised memory of earlier conversations. We send to OpenAI only the text of journal entries you opted in, and only to create the embedding.

We do not send your email address, surname, payment information, location, Private journal entries, or your blocked-app selections.

Because your denomination and your faith-related content reveal religious belief, we ask for your explicit, separate consent before your first message — a screen naming both providers, describing what is sent, and requiring you to tap "Agree & Continue." Declining leaves every other feature of the App working. You may withdraw consent at any time in Settings → Privacy.

Neither Anthropic nor OpenAI uses your data to train models. Both operate under commercial API terms excluding API traffic from training. Anthropic deletes API inputs and outputs within 30 days; OpenAI retains them up to 30 days for abuse monitoring, then deletes them.

We do not retain the raw text of your chat messages. Our Lambda forwards them and discards them. We do store summarised conversation memories in AWS DynamoDB so Theo has continuity across sessions; these expire automatically after 180 days (60 days for short-term context). If you delete your account, deletion of these memories begins immediately and normally completes within minutes; if a service is briefly unavailable we retry with exponential backoff for up to 24 hours.

We may change AI models or providers to improve quality, reliability, or cost. Where the change is material we will notify you in the App and obtain fresh consent before sending your data to a new provider.

5.6 Account Deletion

You can delete your account at any time from Settings > Delete My Account. Deleting your account immediately:

If you are the sole admin of a group, that group is either transferred to another willing admin or dissolved (with members notified). Groups you joined but did not create are unaffected.

5.7 Data Not Stored in Your Account

The following data is stored only on your device and does not sync to your account:

6. Subscriptions and Billing

6.1 Subscription Plans

Theo offers optional paid subscription plans that unlock additional features. The following subscription plans are currently available:

Some features of the App are available without a subscription. The specific features included in free and paid tiers may change over time at our discretion.

6.2 Apple In-App Purchases

All subscriptions are processed exclusively through Apple's In-App Purchase system ("Apple IAP"). By purchasing a subscription, you also agree to Apple's terms and conditions governing In-App Purchases, including Apple's Licensed Application End User License Agreement.

Apple, not Landslide Studios LLC, is the payment processor for all subscription transactions. We do not directly collect, store, or process any payment information such as credit card numbers, billing addresses, or bank account details.

6.3 Free Trial

Certain subscription plans may include a free trial period. The duration and availability of free trials are determined by us and may change at any time. Free trial eligibility, activation, and terms are managed by Apple through its In-App Purchase system.

If you do not cancel your subscription before the end of the free trial period, your subscription will automatically convert to a paid subscription, and you will be charged the applicable subscription fee.

Apple determines whether you are eligible for a free trial. Generally, free trials are available only once per Apple ID and may not be available if you have previously subscribed.

6.4 Auto-Renewal

All subscriptions automatically renew at the end of each billing period (monthly or annually, as applicable) unless you cancel at least twenty-four (24) hours before the end of the current billing period.

Upon renewal, your Apple ID will be charged at the then-current subscription rate. Renewal charges are processed by Apple.

6.5 Cancellation

You may cancel your subscription at any time through your Apple ID account settings on your device. Cancellation instructions are provided by Apple and are generally found at:

Cancellation takes effect at the end of the current billing period. You will continue to have access to subscription features until the end of the period you have already paid for. Cancellation does not entitle you to a refund of any fees already paid.

You cannot cancel your subscription through the App itself.

6.6 Refunds

Refund requests for subscription purchases are handled exclusively by Apple in accordance with Apple's refund policy. We do not process refunds directly.

To request a refund, visit https://reportaproblem.apple.com or contact Apple Support. Refund eligibility is determined solely by Apple.

6.7 Pricing Changes

We reserve the right to change subscription pricing at any time. If we increase the price of a subscription plan, Apple will notify you in advance and, where required, seek your consent before charging the new price. If you do not consent to a price increase, your subscription will not renew at the higher price and will expire at the end of your current billing period.

Existing subscribers. Where we raise the price of a plan, we intend to preserve the rate of subscribers already on that plan for as long as their subscription renews without interruption. If you cancel and later resubscribe, the then-current price applies. Apple administers this through App Store pricing controls; where Apple's systems require your affirmative consent to continue at any price, your subscription will not renew until you give it.

Automatic renewal disclosures. All subscriptions are auto-renewing, and the plan, price, renewal interval, and cancellation method are shown to you before purchase and confirmed in your Apple receipt. Cancellation is always available in Apple ID account settings, in the same medium in which you subscribed, with no retention call, no email requirement, and no hold time. This is intended to satisfy California's Automatic Renewal Law as amended by AB 2863, the federal Restore Online Shoppers' Confidence Act, and equivalent auto-renewal statutes in other states and countries.

Current pricing is displayed within the App and on the App Store listing prior to purchase.

6.8 Taxes

All subscription prices are inclusive of or exclusive of applicable taxes as determined by Apple based on your location. Apple is responsible for collecting and remitting taxes where required.


7. AI-Generated Content Disclaimer

This is a critical section. Please read it carefully.

7.1 Nature of AI-Generated Content

Theo uses artificial intelligence technology, including models operated by Anthropic PBC and OpenAI, L.L.C., to generate conversational responses, devotional content, Scripture-related commentary, and other text-based output ("AI-Generated Content"). This content is produced by machine learning algorithms and is not written, reviewed, or approved by a human being before it is displayed to you.

7.2 No Guarantee of Accuracy

AI-Generated Content may be inaccurate, incomplete, misleading, outdated, or contextually inappropriate. While we make reasonable efforts to design prompts and systems that produce helpful and relevant responses, we cannot and do not guarantee the accuracy, reliability, completeness, or appropriateness of any AI-Generated Content.

Scripture references included in AI-Generated Content should always be verified against an authoritative Bible translation. AI models may misquote, misattribute, or inaccurately paraphrase Biblical text.

7.3 Not a Substitute for Professional Services

Theo is a Bible study companion. It is not and must never be used as a substitute for professional services of any kind. Specifically, Theo is NOT a substitute for:

7.4 Mental Health Crisis Resources

If you or someone you know is experiencing a mental health crisis, suicidal thoughts, or is in immediate danger, please take the following steps:

Do not rely on Theo or any AI-generated response in a crisis situation.

7.5 No Theological Authority

We make no representations or warranties regarding the theological accuracy, doctrinal correctness, or denominational appropriateness of AI-Generated Content. Theo is designed to be non-denominational and inclusive, but AI responses may reflect biases inherent in training data or may not align with your specific theological beliefs or traditions.

AI-Generated Content should not be treated as authoritative spiritual guidance, doctrinal teaching, or Scriptural interpretation. You are encouraged to consult with your own pastor, priest, minister, or spiritual advisor for matters of faith, doctrine, and spiritual direction.

7.6 Assumption of Risk and Release of Liability

By using the AI features of the App, you expressly acknowledge and agree that:

  1. AI-Generated Content is produced by a machine and may contain errors, omissions, or inappropriate material.
  2. You will not rely on AI-Generated Content as a substitute for professional advice of any kind.
  3. You are solely responsible for evaluating and verifying any AI-Generated Content before acting on it.
  4. Any decisions, actions, beliefs, or outcomes resulting from your interaction with AI-Generated Content are your own responsibility.
  5. Landslide Studios LLC, the App, and all associated parties shall not be held liable for any damages, losses, injuries, or harm -- whether physical, emotional, psychological, spiritual, financial, or otherwise -- arising from or related to your use of or reliance on AI-Generated Content.

7.7 Regulatory Disclosures for AI Systems

EU Artificial Intelligence Act. Article 50(1) of Regulation (EU) 2024/1689 requires that people be told, clearly and no later than their first interaction, when they are dealing with an AI system. That obligation has applied since 2 August 2026. Theo satisfies it through a disclosure screen shown before your first message, through the labelling of Theo's replies inside the App, and through Sections 5.5 and 7 of these Terms. Where Theo produces synthetic text within the meaning of Article 50(2), it is marked as machine-generated in the App interface.

California Senate Bill 243 (Companion Chatbots). Effective 1 January 2026, California requires operators of companion chatbot platforms to disclose the artificial nature of the chatbot, to maintain and publish a protocol for responding to expressions of suicidal ideation or self-harm, and to apply additional safeguards for known minors. Without conceding that Theo is a "companion chatbot" as defined in Cal. Bus. & Prof. Code §22601 — Theo exists to support Bible study, not to meet a user's social needs — we comply as though it were:

Not an emergency service. Nothing in this Section makes Theo a crisis line, a counsellor, or a substitute for one. In an emergency, contact your local emergency number.


8. App Blocking Features

8.1 Voluntary Nature

All app blocking features in Theo are entirely voluntary and user-controlled. You choose whether to enable app blocking, which applications to block, and the duration of each blocking session. The App will never block applications without your explicit initiation.

8.2 Technical Implementation

App blocking functionality is implemented using Apple's Screen Time, FamilyControls, ManagedSettings, and DeviceActivity frameworks. These are system-level frameworks provided by Apple Inc. The App does not use any private APIs, device management profiles, or enterprise management tools to restrict app access.

8.3 Resistance and Accountability Features

The App includes optional resistance features, such as requiring you to type a commitment phrase you have chosen in order to end a focus session early. These features are designed solely as personal accountability tools to help you stay focused during sessions you have voluntarily initiated. They are not intended to restrict your access to your device against your will.

The fasting feature allows you to voluntarily block selected apps for extended periods (multiple days). This is also entirely user-initiated and user-controlled.

8.4 Limitations and Risks

You acknowledge and agree that:

8.5 Removing Blocks

You can always remove all app blocks by deleting the App from your device. Deleting the App removes all associated ManagedSettings configurations and restores full access to all previously blocked applications.


9. Bible Content

The App provides access to Bible text from the following translations:

All three translations are in the public domain and are not subject to copyright restrictions. We do not claim ownership of or proprietary rights over the text of these Bible translations.

Bible text is provided for personal study and devotional use. While we make reasonable efforts to ensure the accuracy of the Bible text included in the App, we do not guarantee that it is free from typographical or formatting errors.


10. Prohibited Conduct

You agree not to engage in any of the following conduct while using the App:

  1. Reverse engineering. You may not reverse engineer, decompile, disassemble, decrypt, or otherwise attempt to derive the source code, algorithms, or underlying structure of the App or any part thereof, except to the extent expressly permitted by applicable law notwithstanding this restriction.

  2. Unlawful use. You may not use the App for any purpose that is illegal, unlawful, or prohibited by these Terms, or in any manner that could damage, disable, overburden, or impair the operation of the App.

  3. Circumvention for harmful purposes. You may not attempt to circumvent, disable, or interfere with the App's blocking or accountability features for the purpose of causing harm to yourself or others, or in a manner inconsistent with the App's intended use.

  4. Harmful AI use. You may not use the AI features of the App to generate content that is harmful, abusive, threatening, harassing, defamatory, obscene, fraudulent, or otherwise illegal or objectionable, or to attempt to elicit such content through prompt manipulation.

  5. Misrepresentation of AI content. You may not represent AI-Generated Content as professional advice, including but not limited to medical advice, mental health counseling, legal advice, or authoritative theological teaching.

  6. Commercial exploitation. You may not distribute, sell, license, lease, sublicense, or otherwise commercially exploit the App or any content obtained through the App without our prior written consent.

  7. Interference. You may not interfere with, disrupt, or place an unreasonable burden on the App's infrastructure, servers, networks, or connected services, or attempt to gain unauthorized access to any systems associated with the App.

  8. Automated access. You may not use bots, scrapers, crawlers, or other automated means to access or interact with the App or extract content from it.

  9. Social abuse. You may not spam other users with friend requests, repeatedly contact users who have declined friend requests or blocked you, or otherwise harass other users through the social features.

  10. Feed scraping and group abuse. You may not scrape, bulk download, or scrape group feed posts or user profile data. You may not post spam, commercial content, or malicious links to group feeds.

  11. Leaderboard abuse. You may not manipulate, artificially inflate, or attempt to game leaderboard rankings through fraud, collusion, or other deceptive means.


11. Intellectual Property

11.1 Our Intellectual Property

The App, including but not limited to its source code, object code, design, layout, user interface, graphics, animations, the Theo mascot character and associated artwork, branding, logos, icons, audio, and all other creative elements (collectively, "App Content"), is the proprietary property of Landslide Studios LLC and is protected by United States and international copyright, trademark, and other intellectual property laws.

These Terms do not grant you any right, title, or interest in the App Content except for the limited license to use the App as described in Section 4.

11.2 Bible Text

As stated in Section 9, the Bible text included in the App (WEB, KJV, and ASV translations) is in the public domain. We do not claim intellectual property rights over Bible text.

11.3 Your Content

Any content you create within the App -- including highlights, notes, bookmarks, reading preferences, and journal entries ("User Content") -- remains your property. We do not claim ownership of User Content.

By using the App, you grant us a limited, non-exclusive license to process and store your User Content solely for the purpose of providing the App's functionality to you. This license terminates when you delete the App, delete specific content, or delete your account.

You are responsible for the content of journal entries you choose to share to groups and posts you choose to make to group feeds. Do not share sensitive personal information, financial details, or any content you would not want other users to see.

11.4 Feedback

If you submit feedback, suggestions, bug reports, or ideas about the App ("Feedback"), you grant us an unrestricted, irrevocable, perpetual, royalty-free license to use, modify, and incorporate such Feedback into the App or any other product or service without obligation or compensation to you.


12. Disclaimers

THE APP AND ALL CONTENT, FEATURES, AND SERVICES PROVIDED THROUGH THE APP ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, Landslide Studios LLC expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:

Without limiting the foregoing, we specifically disclaim any warranty that:

The App relies on third-party services, including Apple's frameworks (FamilyControls, ManagedSettings, DeviceActivity), Supabase (cloud database), Anthropic's API (AI replies), OpenAI's API (journal embeddings), AWS (Lambda and DynamoDB), Firebase Crashlytics (crash reporting), PostHog (analytics), and Apple's Sign in and StoreKit systems. We have no control over these third-party services and make no warranties regarding their performance, availability, or reliability.

Your use of the App is at your sole risk.


13. Limitation of Liability

13.1 Exclusion of Damages

To the maximum extent permitted by applicable law, in no event shall Landslide Studios LLC, or any of its members, managers, employees, affiliates, agents, contractors, licensors, or service providers, be liable for any:

whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

13.2 Cap on Liability

To the extent that any liability is found notwithstanding the above exclusions, Landslide Studios LLC's total cumulative liability to you for all claims arising out of or relating to these Terms or the use of the App shall not exceed the greater of:

13.3 Jurisdictional Limitations and Consumer Protection Carve-Outs

Some jurisdictions do not allow the exclusion or limitation of certain damages. Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot be limited or excluded under the laws of the jurisdiction where you reside, including mandatory consumer protection laws in the European Economic Area, the United Kingdom, and certain US states. The liability cap in Section 13.2 does not apply to consumers in such jurisdictions to the extent local law prohibits pre-dispute caps below specified statutory amounts.

In such jurisdictions, our liability shall be limited to the minimum extent permitted by applicable law. Nothing in these Terms is intended to exclude or limit any liability that cannot be lawfully excluded or limited.

13.4 Essential Basis of the Agreement

You acknowledge and agree that the disclaimers and limitations of liability set forth in these Terms reflect a reasonable and fair allocation of risk between you and Landslide Studios LLC, and that these limitations form an essential basis of the bargain between us. Landslide Studios LLC would not be able to provide the App to you on an economically reasonable basis without these limitations.


14. Indemnification

You agree to indemnify, defend, and hold harmless Landslide Studios LLC and its members, managers, employees, agents, contractors, service providers, and affiliates from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to:

  1. Your use of or access to the App.
  2. Your violation of these Terms.
  3. Your violation of any applicable law, regulation, or third-party right.
  4. Any content you submit, transmit, or make available through the App, including journal entries shared to groups or feed posts.
  5. Any claim that your use of the AI features caused harm to you or any third party.
  6. Any claim related to your use of the app blocking features, including claims arising from missed communications, obligations, or emergencies.
  7. Any dispute with another user regarding social features, group membership, leaderboard rankings, or user-generated content.

This indemnification obligation shall survive the termination of these Terms and your use of the App.


15. Termination

15.1 Termination by Us

We may suspend or terminate your access to the App or your account at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, conduct that we reasonably believe is harmful to other users, the App, or third parties, spam or harassment of other users, unauthorized access attempts, or discontinuation of the App.

15.2 Termination by You

You may terminate your use of the App at any time by deleting it from your device. If you have an active subscription, you must also cancel it through your Apple ID account settings to avoid future charges. Deleting the App alone does not cancel your subscription.

You may terminate your account by navigating to Settings > Delete My Account, which will permanently delete your profile, journals, journals embeddings, friends, group memberships, subscription records, streaks, and conversation memories.

15.3 Effect of Termination

Upon termination of your right to use the App:

The following sections shall survive termination: Section 5 (portions relating to data treatment and security), Section 7 (AI-Generated Content Disclaimer), Section 10 (Prohibited Conduct), Section 11 (Intellectual Property), Section 12 (Disclaimers), Section 13 (Limitation of Liability), Section 14 (Indemnification), Section 16 (Governing Law and Disputes), Section 17 (Miscellaneous), and this Section 15.3.


16. Governing Law and Disputes

16.1 Governing Law

These Terms and any disputes arising out of or relating to these Terms or the App shall be governed by and construed in accordance with the laws of the State of North Carolina, United States of America, without regard to its conflict of law principles.

16.2 Jurisdiction and Venue

Any legal action, suit, or proceeding arising out of or relating to these Terms or the App shall be brought exclusively in the state or federal courts located in the State of North Carolina, United States of America. You hereby irrevocably consent to the personal jurisdiction and venue of such courts and waive any objection based on inconvenient forum or lack of jurisdiction.

If you are a consumer resident in the European Economic Area, the United Kingdom, or another jurisdiction whose laws prohibit pre-dispute choice-of-forum clauses against consumers, you may also bring proceedings in the courts of your country of residence, and these Terms shall be interpreted as not waiving any mandatory consumer-protection right you hold under your local law.

16.3 No Mandatory Arbitration

These Terms do not require mandatory binding arbitration. All disputes shall be resolved through the court system as described in Section 16.2.

16.4 Territories Where Theo Is Offered

As of 31 August 2026, Theo is not offered in the European Economic Area, the United Kingdom, or Switzerland. We withdrew the App from every App Store territory in those regions, and we do not market or make it available there.

If you hold a legacy account created before the withdrawal, these Terms continue to govern your use, nothing in them removes a right you hold under the mandatory consumer law of your country, and any term a court finds unfair under that law is not binding on you while the rest of these Terms continue in force. The European Commission's Online Dispute Resolution platform was discontinued on 20 July 2025 and is no longer available; your national European Consumer Centre, listed at eccnet.eu, is the appropriate contact point.

Subscriptions are sold and administered by Apple as merchant of record. Refunds, cancellations, and any statutory right of withdrawal are handled by Apple at reportaproblem.apple.com.

Each party shall bear its own costs and expenses, including attorneys' fees, in connection with any dispute arising under these Terms, unless a court orders otherwise in accordance with applicable law.

16.6 Time Limitation

To the extent permitted by applicable law, any claim or cause of action arising out of or related to these Terms or the use of the App must be filed within one (1) year after such claim or cause of action arose. Failure to file within this period shall result in the permanent barring of such claim.


17. Miscellaneous

17.1 Entire Agreement

These Terms, together with the Privacy Policy and any other policies or guidelines referenced herein, constitute the entire agreement between you and Landslide Studios LLC regarding your use of the App and supersede all prior or contemporaneous agreements, understandings, representations, and warranties, whether written or oral, relating to the subject matter hereof.

17.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The invalidity, illegality, or unenforceability of any provision shall not affect the validity, legality, or enforceability of the remaining provisions, which shall continue in full force and effect.

17.3 Waiver

The failure of Landslide Studios LLC to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. A waiver of any provision shall be effective only if made in writing and signed by Landslide Studios LLC. No waiver of any provision shall be deemed a further or continuing waiver of such provision or any other provision.

17.4 Assignment

You may not assign, transfer, or sublicense any of your rights or obligations under these Terms without our prior written consent. Landslide Studios LLC may assign these Terms, in whole or in part, at any time without notice to you. Any attempted assignment in violation of this section shall be void.

17.5 No Third-Party Beneficiaries

These Terms are for the benefit of you and Landslide Studios LLC only. No third party shall have any right to enforce any provision of these Terms, except that Apple Inc. may be considered a third-party beneficiary of these Terms solely to the extent required by Apple's agreements governing App Store distribution.

17.6 Governing Language

These Terms and our Privacy Policy are drafted in English. Translations are provided inside the App for your convenience. If a translation and the English text conflict, the English text governs, except where the mandatory consumer law of your country requires otherwise, in which case the translation in your official language prevails to the extent that law requires. The current English text is always available at the published URLs in Section 18.

17.7 Force Majeure

Landslide Studios LLC shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, labor disputes, government actions, power failures, internet or telecommunications failures, or failures of third-party service providers (including Apple, Supabase, Anthropic, OpenAI, AWS, and Firebase).

17.8 Headings

The section headings in these Terms are for convenience only and shall not affect the interpretation or construction of these Terms.

17.9 Electronic Communications

By using the App, you consent to receiving communications from us electronically, including through push notifications (if you have enabled them) and through notices posted within the App. You agree that all notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
